In this paper, we utilized triangular conorms. The essence of using S-norm is that the similarity order does not change using different norms. In fact, we are investigating for a new conception for calculating the similarity of two Fermatean fuzzy sets. For this purpose, utilizing an S-norm, we first present a formula for calculating the similarity of two Fermatean fuzzy values, so that they are truthful in similarity properties. Following that, we generalize a formula for calculating the similarity of the (...) two Fermatean fuzzy sets which prove truthful in similarity conditions. Finally, various numerical examples have been presented to elaborate this method. (shrink)

The Liber de compositione alchemiae or the The Book of the Composition of Alchemy is believed to have been the first book on alchemy that was translated from Arabic into Latin. The translator was the Englishman Robert of Chester who was one of the earliest translators to flock to Spain to learn Arabic and to translate some of the Arabic works. He completed his translation on 11 February, 1144.

Ḥadīths have been preserved and recorded in various ways since the Companions. These activities continued dur-ing the Tābiīn (the successors of the Companions) Period. So much so that these methods have formed the infra-structure of other methods that will emerge later. In this context, before the 70's (A.H.), works named al-Aṭrāf appeared. However, these first works consisted of the notes that they wrote some of the ḥadīths before coming to the science assemblies to help students remember in ḥadīth learning. Ḥadīth (...) scholars have adopted and applied this method in a very short time. Thus, this method also provided the opportunity for the formation of the first written ḥadīth documents. In addition, with the writing of ḥadīth works, it has turned into a system of al-Taṣnīf and al-Takhrīj in order to make maximum use of these books and to reach the source of a narration that is tried to be found. As a result, al-Aṭrāf literature, which can be evaluated as index, has emerged. As a matter of fact, the first examples of this literature, arranged alphabetically according to the names of the Companions or ḥadīth texts, started to be given since the 4th (A.H.) century. In this way, the way to quickly benefit from the accumulation of the ḥadīth area has been opened. This article focuses on the historical adventure of al-Aṭrāf and their contributions to the ḥadīth field, as well as literature knowledge of the works of al-Aṭrāf which are of great importance for both al-Kitābah, al-Taṣnīf and al-Takhrīj.Summary: In order to understand and practice the religion of Islām, great efforts have been made both in the past and later periods in order to convey the words, verbs, interpretations and qualifications of the Prophet to the next genera-tions as they are protected from all kinds of falsification and changes. This process, which started with memoriza-tion and partly writing at the beginning, has gained momentum with the use of other methods since the period of Tābiīn. In this context, the method of aṭrāf was started to be used to facilitate memorization, to be a reminder, and to transmit the ḥadīth through the hearing of the ḥadīth sheikh. The first examples of this method were seen by Muḥammad b. Sīrīn during his participation of his teacher Abīde/Ubayda Salmān in the scholarly assembly. At this stage, the relevant method was manifested as writing a passage from the beginning of the ḥadīth. Thus, the aforementioned method, which had great contributions in recording and memorizing ḥadīths in accordance with the original, has gained widespreadness and application among the ḥadīth scholars like Ubeydullaḥ b. Omar, Shu’bah b. al-Ḥajjāj, Sufyān as-Sawrī, Mālik b. Anas, Ismāīl b. Ayyāş and Vakī b. Jarrāḥ in a very short time. In this context, Yazīd b. Zuray’ stated that he went to his teacher without his aṭrāf work of ḥadīths which he transmitted from Shu’bah and listened to ḥadīth in this way. Therefore, this mentioned event is important in terms of putting forth that Shu’bah allowed the aṭrāf method in his assemblies. The method was used by Aḥmad b. Ḥanbal, who traveled to Madīnah to convey the reports recorded with the mentioned method of his teacher Abū Alḳama al-Farawī and at the same time listen to the related transfers from him, but who could not reach his goal. Therefore, the related narrations show that aṭrāf method was used effectively by ḥadīth scholars to remember the ḥadīths in the 1st and 2nd centuries, so sections from the narrations were written during the preparatory stage before coming to the scholarly assembly. Ultimately, the importance of these works, which manifest in different ways and offer great contributions to writing, is an undeniable reality for the history of ḥadīth.Aṭrāf, the plural form of taraf that literally means the side and edge of something, mean a section, phrase or first part that indicates the whole of the ḥadīth. This method, along with the formation of ḥadīth literature, has been started to be given as a name to the works organized alphabetically according to the name of the Companions or ḥadīth texts by mentioning some of the ḥadīths with the 4th century. In this sense, aṭrāf has started to become a unique literature in a sort of taṣnīf and takhrīj method in order to make use of the ḥadīth writing easier.Aṭrāf studies may aim to bring together the isnāḍs (chains of transmitters) in all books, or they can be limited to the chains in certain books. Aṭrāf books contain the ḥadīths in the Ṣaḥīḥān or Kutub al-Sittah and are written in alphabetical form based on the name of the companions or according to the texts of ḥadīth. The first of these, which has the attribute of the musnad in a sense, is arranged in alphabetical order according to the name of the Companion, and if there are many people who narrate from him, according to the names of the tābiīn and taba-i tābiīn (successors of the tābiīn). Accordingly, the narrations of each companion were determined and listed in al-phabetical order in aṭrāfs in musnad-type, and a passage was written from the ḥadīths and marked as books/chapters in the places of relevant narration. On the other hand, the second type of aṭrāf books were ar-ranged by giving a few words from a section that allows remembering the head or all of the ḥadīths without in-cluding chains, and then placing these texts in alphabetical order.The type of aṭrāf offers the opportunity to see different chains of narrations together and provides many facilities for the ḥadīth researchers. Therefore, ḥadīth researchers show great interest in this genre. Aṭrāfs provide many benefits for both ḥadīth chain and text. In this respect, it is possible to talk about many advantages of the ḥadīth to its transmister such as the determination of mutawātīr, garīb, azīz, mashhūr, mutābī or the testimony of ḥadīth; to provide facility to make a reputation research of a riwāyah (narration), to provide an opportunity to determine the location of the narrations in the primary sources; to detect the link or any blackout in the chain, to reach the nu-merical knowledge of ḥadīth narrated by a companion or other narrators, to obtain information about narrators whose identity is not explicitly stated, to know the first narrator, to provide the protection of the ḥadīths from taḥrīf or alteration, to give the opportunity to identify the subject they contain, to be able to obtain text integrity by getting various chains, the detection of the sabab al-wurūd (the context of ḥadīth).Due to the contributions we have mentioned above, many books on aṭrāf literature that started with Abu’l-Ḥasen Ali b. Omar ad-Dārakutnī have been published. Among them Aṭrāfu’s-ṣaḥīḥayn/el-Jem`u bayna’s-ṣaḥīḥayn by Abū Mas`ūd Ibrāhīm b. Muḥammad b. Ubayd ad-Dimashkī, Aṭrāfu’s-ṣaḥīḥayn by Abū Muḥammad Ḥalaf b. Muḥammad b. Ali al-Vasiṭī, Zaḫāiru’l-mavārīs fi’d-dalālati alā mavāzi`i’l-hadīs by Abdülganī b. İsmāīl en-Nāblūsī and Tuḥfatu’l-ashrāf bi ma`rifati’l-aṭrāf by Abu’l-Ḥajjāj Yūsuf b. Abdurrahman el-Mizzī can be mentioned. Some of the related works are arranged in musnad style while others are arranged according to the first word of ḥadīth texts. As a result, the method of aṭrāf has become a kind of indexer in order to facilitate reaching the source of the re-ports and make the highest level of use required by the classification and bookings of the ḥadīths in the 3rd centu-ry. These works, arranged alphabetically in the name of the Companions or according to the texts of the ḥadīth, have taken their place in the history of the ḥadīth with their many examples, both in the form of taṣnīf and the method of takhrīj by mentioning a part of the ḥadīth by the head. This article proposes an analysis of changes implemented during Malaysia's Prime Minister Abdullah Ahmad Badawi's administration (20032003), which displayed bias against changes and introduced schemes to justify the systems it upheld. Transmutations wrought during Abdullah's tenure may have been neither substantial nor totalizing, but within the conservative paradigm which had long gripped national politics, Abdullah's deviations were significant nevertheless.

The aim of present paper is to introduce the concept of ‘expressive perception’ in Ernst Cassirer’s philosophical mythology. Having Cited Dorothy Emmet’s methodological objection, the author, by recalling Kantian aspect of Cassirer’s thought and referring to the concept of ‘expressive perception’, would make an attempt to reply on his part: according to Cassirer, this level of perceptive experience is the origin of the mythical form of thinking as a whole and, at the same time, is the original and irreducible altogether. Thus, taking ‘mythical thought’ as an independent form of thinking, beside the ‘critical-empirical’ form of thinking, is, for one thing, completely cogent; for another, due to its dependency upon expressive form of perception, mythical thought would never be quite omitted, rather, keep living latently beneath the skin of mental life. In addition, author explains how much Cassirer owes, regarding to the concept of ‘expressive form of perception’, to Max Scheler. Avoiding to elaborate on Scheler’s detailed argument, Cassirer relies strongly on the consequences Scheler draws from his considerations in his work ‘Wesen und Formen der Sympathie’. Restating Scheler’s argument briefly should help in understanding Cassirer’s idea. (shrink)

Résumé Cet article porte sur l’analyse des interrelations entre les pratiques non officielles du sulh, de la réconciliation, et le travail des cours de justice à partir d’enquêtes menées en Algérie et, subsidiairement, au Soudan. J’illustrerai en particulier l’idée que le sulh – action faisant bien souvent référence au ‘ûrf (conventions usuelles ou droit coutumier) ou encore à la loi coranique et aux jurisprudences musulmanes (malékite en particulier) – s’inscrit en continuité et en complément avec le travail judiciaire. Je propose (...) ici de réfléchir à la pluralité des acteurs, mais également aux dimensions spatiales et temporelles qui orientent l’ensemble du processus articulant pratiques non officielles de réconciliation et celles (officielles) des cours de justice. Nous avons en effet une pluralité de lieux – lieu du crime, lieux de la réconciliation, cours de justice – qui imprègnent et l’interprétation que l’on se fait de l’offense et le procès socio-légal (réconciliation/cours de justice) dans son ensemble. Je discuterai ainsi des conséquences pratiques et théoriques de cette articulation entre réconciliation (sulh) et processus judiciaire. (shrink)

The neglect of psycho-spiritual needs of patients as they traverse the modern healthcare system has been a featured theme in medical literature over the past decade. This literature, which often highlights in-patient palliative care, as well as acute and critical care settings, influences practice guidelines and protocols of doctors and nurses. In this essay, I review some of the pertinent issues raised in the literature and examine the validity of placing an ethical perspective on this issue. I also compare Islamic (...) theocentric perspectives with secular, non-theistic perspectives on restoring psycho-spiritual care for patients. I then develop a framework for pastoral intervention based on aspects of the Islamic tradition and elaborate this framework by addressing clinical contexts and cases. The essay is an exposition based upon a review of the modern medical literature, an analysis of some of the traditional Islamic written sources, and the observations of the investigator, a practicing physician and an American Muslim. The weaponizing of scientific expertise to oppose regulation has been extensively studied. However, the relevant studies, belonging to the emerging discipline of agnotology, remain focused on the analysis of empirical corruption: of misinformation, doubt mongering, and other practices that cynically deploy expertise to render audiences ignorant of empirical facts. This paper explores the wrongful deployment of expertise beyond empirical corruption. To do so, I develop a broader framework of morally subversive expertise, building on recent work in political philosophy (Howard, 2016). (...) Expertise is subversive if it sets up its audience to fail morally, either intentionally or negligently. I distinguish three modes of subversive expertise: empirical subversion (the focus of agnotology), normative subversion and motivational subversion. Drawing on these distinctions, I offer a revisionary account of the Trump Administration’s regulatory science as a case study. I show that the Trump Administration’s use of expertise to dismantle climate regulation, contra the standard charge, cannot be explained using the resources of agnotology alone: the Administration produced highly reliable climate assessments, detailing the risks of climate change, candidly admitting the harms of its proposed policies, and still successfully deployed these findings to justify massive climate deregulation. The lesson of the analysis is that dismissing the expertise that underpins climate deregulation as empirically corrupt ‘anti-science’ both obscures its actual role in the politics of climate change and understates its wrongfulness: it misses the breadth of the assault on moral agency that sustains climate injustice. This paper examines the history of glass colouring. It reviews Kitāb al-Durra al-maknūna of Jābir ibn Ḥayyān, which deals with the subject. The manuscript of this practical treatise was discovered recently. Part one of the paper deals with Jābir as a philosopher and chemist. The art of lustre-painting on glass originated in Syria during the Umayyad Caliphate in the eighth century and was soon practised in the neighbouring area. The paper reviews Arabic literature that deals with the colouring of glass (...) until the 13th century, and with pre-Islamic and Latin books of recipes that deal with glass colouring. Recipes for cast coloured glass are very few and scant in non-Arabic literature, and lustre-painting on glass was not mentioned in any treatise outside Arabic, even in the works of Theophilus and Neri. The colouring of glass gemstones by colour diffusion is not mentioned also. The paper compares the recipes of Kitāb al-Durra with the results of modern analysis of existing Islamic stained glass objects. There is a close correspondence, and the main indispensable ingredients in both cases are silver and copper compounds. Part one ends with an account of lāzaward as cobalt oxide in glass colouring. Part two of the paper gives a representative selection of recipes from Kitāb al-Durra for the three methods of glass colouring. (shrink)

This article examines the relationship between religion, tradition and identity as seen from the myth about eclipses in a village in Central Java. Javanese people in rural areas still hold beliefs passed down from their ancestors about eclipses, both lunar and solar eclipses. Using a qualitative approach, the results of the study showed that the villagers believe that eclipses occur because of evil giants called buto named Batara Kala who try to devour the sun or the moon. This natural phenomenon (...) is believed to bring disaster to pregnant women and livestock. To fight the disaster, they must perform certain ceremonies or rituals. Based on ethnographic studies, this research provides an overview of eclipse mythology for Javanese locals and analyses it from identity theory. This shows that mythical rituals reflect a continuous identity formation. Although the traditions associated with these myths to some extent transcend the boundaries of the Islamic religion, they remain unchallenged. CONTRIBUTION: This research suggests that myths play an important role in the life and identity of the people who believe in them and perform the rituals associated with them. (shrink)

BackgroundThe pharmaceutical market in Bangladesh is highly concentrated. Due to high competition aggressive marketing strategies are adopted for greater market share, which sometimes cross limit. There is lack of data on this aspect in Bangladesh. This exploratory study aimed to fill this gap by investigating current promotional practices of the pharmaceutical companies including the role of their medical representatives.MethodsThis qualitative study was conducted as part of a larger study to explore the status of governance in health sector in 2009. Data (...) were collected from Dhaka, Chittagong and Bogra districts through in-depth interview, observation, and round table discussion.ResultsFindings reveal a highly structured system geared to generate prescriptions and ensure market share instituted by the pharmaceuticals. A comprehensive training curriculum for the MRs prepares the newly recruited science graduates for generating enough prescriptions by catering to the identified needs and demands of the physicians expressed or otherwise, and thus grab higher market-share for the companies they represent. Approaches such as inducements, persuasion, emotional blackmail, serving family members, etc. are used. The type, quantity and quality of inducements offered to the physicians depend upon his/her capacity to produce prescriptions. The popular physicians are cultivated meticulously by the MRs to establish brand loyalty and fulfill individual and company targets. The physicians, willingly or unwillingly, become part of the system with few exceptions. Neither the regulatory authority nor the professional or consumer rights bodies has any role to control or ractify the process.ConclusionsThe aggressive marketing of the pharmaceutical companies compel their MRs, programmed to maximize market share, to adopt unethical means if and when necessary. When medicines are prescribed and dispensed more for financial interests than for needs of the patients, it reflects system’s failed ability to hold individuals and entities accountable for adhering to basic professional ethics, code of conduct, and statutory laws. This paper explores the representation of Laji’een and Muhajireen in Jordan News Agency. It uses the headlines of a 2.5 million word corpus of Arabic news articles in a time span of 5 years from 2012 to 2016. Chronologically analyzing the headlines shows a change in the representation of and attitudes towards refugees and migrants over the investigated period. The analysis of the headlines shows that 2012 starts with providing the assistance to the refugees then at a later stage of (...) 2012 and in 2013 and 2014, the language is shifted to calling for assistance to the country to contribute to solving the problem. In 2015, the language is changed to be more alerting about the scarce in funding. In 2016, the headlines have changed the focus to Europe due to the migration of the refugees. This motivates the National News Agency of Jordan to highlight the suffering of Europe because of the refugees despite having the capacity and resources to host the migrant refugees. The paper concludes that language in general, and the language of media in particular can change the attitudes of people and governments toward critical issues and phenomena like migration and asylum. Little is known about the background of atheism in Malaysia and how Muslims respond to the phenomenon, although provocations by Malaysian atheists often take place on social media. This study addressed the gap by exploring the atheism phenomenon in Malaysia’s ethnoreligious-oriented society. Data were collected from in-depth interviews and content analysis using the qualitative method. All data were analysed thematically using the software for qualitative analysis, ATLAS.ti. The resulting superordinate themes that emerged from the analysis include the phenomenon of Malaysian (...) atheism, the factors for becoming atheists and the theme of arguments. The study’s findings are three-fold. Firstly, atheism started in Malaysia after globalisation began. Secondly, most Malaysian atheists were influenced by internal factors based on emotional–psychological elements rather than being scientifically oriented. Last but not least, the main themes of Malaysian atheist arguments are ‘God’s justice’, ‘the problem of evil’ and ‘science rationalism’. As a response, Muslims counter the atheism phenomenon by providing an effective approach to preserving social cohesion and harmony in an ethnoreligious society.Contribution: This article suggests that although atheism is regarded as a challenge to society since Malaysia is an ethnoreligious-oriented society, atheism needs to be countered through proper education as early prevention, besides encouraging healthy discussions. In this paper, we present a non-geometrodynamic quantum Yang–Mills theory of gravity based on the homogeneous Lorentz group within the general framework of the Poincare gauge theories. The obstacles of this treatment are that first, on the one hand, the gauge group that is available for this purpose is non-compact. On the other hand, Yang–Mills theories with non-compact groups are rarely healthy, and only a few instances exist in the literature. Second, it is not clear how the direct observations of (...) space–time waves can be explained when space–time has no dynamics. We show that the theory is unitary and is renormalizable to the one-loop perturbation. Although in our proposal, gravity is not associated with any elementary particle analogous to the graviton, classical helicity-two space–time waves are explained. Five essential exact solutions to the field equations of our proposal are presented as well. We also discuss a few experimental tests that can falsify the presented Yang–Mills theory. (shrink)

This paper discusses Al-Rāniri ‘s criticism of the theological conception in Nusantara Sufism which contains elements of pantheism. This paper begins by describing the teachings of Waḥdah shuhūd in Sufism Al-Rāniri. This teaching believes in God, Allah as the only one and only being, while the universe is only a madzhar that testifies to the oneness of Allah Himself. That is why a being other than Allah is not separate, it is neither independent nor one with God. Based on this (...) view, Al-Rāniri criticizes, even kafuses the wujūdiyah followers because they tend to be pantheistic which unites God,Allah and humans. The Sufism teachings developed by Al-Rāniri were able to bring together sharia and Sufism. This teaching can be accepted by the people of the archipelago, Aceh in particular because the people of the Archipelago in the following years were colored by Sunni teachings that uphold the practice of sharia. This paper aims to find the position of Waḥdah shuhūd teachings in the context of Nusantara Islamic studies, especially in the field of Sufism, whose roots cannot be separated from the development of Sufism in the 17-18 century. Therefore, this study uses a descriptive-analytical approach while adhering to the accuracy of the analysis data that has been carried out by previous researchers. (shrink)

Histopathological lung cancer segmentation using region of interest is one of the emerging research area in the field of health monitoring system. In this paper, the histopathological images were collected from the database Stanford Tissue Microarray Database (TMAD). After image collection, pre-processing was performed using a normalization technique, which enhances the quality of the histopathological image by eliminating unwanted noise. After pre-processing, segmentation was carried out using the modified kernel-based fuzzy c-means clustering (KFCM) approach along with the edge bridge and (...) fill technique (EBFT). It was a flexible high-level machine learning technique to localize the object in a complex template. The experimental result shows that the proposed approach segments the normal and abnormal cancer regions by means of precision, recall, specificity, accuracy, and Jaccard coefficient. The proposed methodology improved the classification accuracy in lung cancer segmentation up to 2.5–5% compared to the existing methods deep convolutional neural network (DCNN) and diffusion-weighted approach. Der Islam vertritt als Offenbarungsreligion den Standpunkt der absoluten Einheit Gottes. Wie wird aber theologisch nach diesem Einen gefragt? Worin besteht die Unbedingtheit Gottes in Relation zum Bedingten? Und warum erschafft Gott überhaupt etwas? Die Systematik der genuin islamischen Theologie fordert in diesem Zusammenhang mit dem Glauben zu beginnen. Doch die Frage ist, wie der Glaube verfasst ist und wie seine Inhalte generiert sind. Was tun wir, wenn wir glauben? In welchem Verhältnis stehen der Verstand und der Glaube zueinander? Und (...) vor allem: Wie ist Offenbarung möglich? Der Koran als Offenbarung beansprucht nämlich Wahrheit; eine Wahrheit, die aber ästhetisch vermittelt ist. In welcher Relation stehen indes Wahrheit und Schönheit des Korans zueinander? Offenbarung ist stets Vermittlung; doch wie lassen sich Transzendenz und Existenz zusammendenken? Grundlegend also: Worin besteht der Standpunkt der systematisch-islamischen Theologie? The integration of modern Western philosophy with the study of Sufism tradition wasn’t quite familiar. So far, philosophical Sufism is often studied from the perspective of neo-platonic philosophy which is famous for its emanation doctrine. Through this research, the author proposes a new integration by using the philosophical concept of Heidegger’s hermeneutics and Roland Barthes’s semiotics as perspectives in studying the phenomena of the philosophical Sufism tradition. The hermeneutic theory of Martin Heidegger used in this research is existential primordial verstehen (...) and the theory of facticity. Whereas Semiotic theory used in this research is Roland Barthes’s theory of order of signification which is used to analyze Sufi’s connotative interpretation of the Qur’an verse. The method used in this research is analysis descriptive by a combined table of hermeneutic and semiotic theories through library research on several primary sources concerning Sufi’s interpretation such as Miftahus Sufi, al-Luma‘, Shaṭaḥāt al-Sūfiyyah, etc. As a result, in the perspective of Sufism Primordial Verstehen, the doctrines of Sufism such as ittiḥād, ḥulūl, and waḥdah al-wujūd could be understood as existential primordial understanding in contemplating Sufi’s existence in the world and his arrival at the understanding of Allah as the only existing Being. Purpose This paper aims to study the developed countries’ experience on the cyberbullying legal regulation among adolescents, to identify existing shortcomings in the developing countries’ laws and to develop recommendations for regulatory framework improvement. Design/methodology/approach The authors have studied the state regulatory practice of the UK, the USA, Canada, Malaysia, South Africa, Turkey, UAE and analyzed the statistics of 2018 on the cyberbullying manifestation among adolescents in these countries. Findings The study results can encourage countries to create separate cyberbullying legislation (...) and periodically review and modify already existing legislation. Originality/value The study provides a list of the recommendations to regulate cybercrime in developing countries and prevent it as well. The results may contribute to creating laws related to the regulation of cyberbullying in countries where such legislation does not exist yet or existing regulatory legal acts do not bring the expected results, namely, in Post-Soviet countries and other developing countries of the world. This study provides a detailed description of ways in which Muslim astronomers handled the Greek astronomical legacy, reassessed its cultural and philosophical implications in light of their religiously-inspired world view, and proposed to modify it.

Bu çalışma hicrî birinci asrın ikinci yarısında Basra’da hadis ve fıkıh sahasındaki ilmî hareketliliği konu edinir. İlgili dönemde, orada yaşayan sahâbenin en meşhuru ve Hz. Peygamber’le en uzun süre birlikteliğe sahip olması hasebiyle, Enes b. Mâlik’in Basra’daki etkisi özel olarak ele alınır. Bu amaçla Enes b. Mâlik’le ilgili birçok rivayet tahlil edilir ve onun hem Basra’da hem de diğer şehirlerde yaşayan sahâbe ve tâbiûnla arasındaki ilmî ilişkileri üzerinde durulur. Çalışma mezkûr zaman diliminde Basra’da hadis faaliyetlerinin fazla, fıkıh faaliyetlerinin ise az (...) olduğunun tezahürlerini gösterir. Enes’in öğrencileri üzerindeki etkisi; öğrencilerinin fakih mi yoksa muhaddis mi olduğu araştırılır. Enes’in tabiûnla ilişkileri, kendisine yapılan rihleler, başka şehirlerde yaşayan fakih tabiûnun ondan rivayeti, İbn Ebî Şeybe’nin Musannef’i çerçevesinde onun fıkhî şahsiyeti ve başka meseleler incelenir. Böylece onun fıkhî melekesinin İbn Abbas ve İbn Ömer’le aynı derecede olmadığı ve benzer şekilde Basra’nın sahabenin fakihlerinden tabiûnun fakihlerine nakledilen “amel-i mütevâres”e önem veren Medine ve Kufe gibi bir fıkıh şehri olmadığı sonucuna ulaşılır. Basra, müksirûndan olan sahabî Enes b. Malik sayesinde hadislerin rivayetine, yayılmasına ve onlarla amel edilmesine önem verilen bir şehirdi. Ancak bu hadislerin yayılması aynı dönemde Mekke’de İbn Abbas’ın faaliyetleri ile kıyaslanabilecek bir fıkhî faaliyeti de beraberinde getirmedi. Dolayısıyla Basra sahabe döneminde fıkıh ilmî açısından geri kalırken hadis sahasında hareketliydi. Bu nedenle ona fıkıh ve “amel-i mütevâres” değil rivayet şehri denilmesini hak etmektedir. (shrink)
